This privacy policy explains which personal data the iOS app "Aber hier leben.." processes, for what purpose, and on what legal basis. It applies exclusively to the app itself.
The core statement up front: Location data and all other data never leave your device. "Aber hier leben.." has no backend, no servers, no user accounts, and no tracking. All processing happens exclusively locally on your iPhone.
The data controller within the meaning of the General Data Protection Regulation (GDPR) is the natural person who publishes "Aber hier leben.." as a sole developer:
The full contact details of the data controller are also available in the Imprint. The data controller and the person named in the Imprint are identical.
"Aber hier leben.." is published by a single individual as a sole developer. A data protection officer is therefore not legally required, and none has been appointed.
"Aber hier leben.." processes personal data for two purposes:
The legal basis is your consent and the provision of the service you have explicitly requested (Art. 6(1)(a) and/or (b) GDPR). The location permission you grant in iOS settings is itself the act of consent: without your permission, "Aber hier leben.." does not access your location.
"Aber hier leben.." processes only the following categories of data - and exclusively locally on your device:
UserDefaults.
The read-only election results database shipped with the app contains exclusively public statistical data (official election results) and no personal data.
None. "Aber hier leben.." does not transmit any data - neither your location nor any other data - to third parties. There is no backend, no server, no third-party interface, no user accounts, and no analytics or tracking services.
Location data and all other data never leave your device.
None. Because "Aber hier leben.." does not transmit any data at all, no transfer to a third country outside the European Union takes place either.
UserDefaults
until you change them or delete the app from your device.
You have the following rights under the GDPR:
In practice, exercising most of these rights is moot because "Aber hier leben.." does not collect or store any data on the server side: there is no data record about which information could be provided or which could be rectified. You effectively exercise the right to erasure by removing the app from your device - this deletes all locally stored data. Independently of that, you can contact a data protection supervisory authority at any time.
"Aber hier leben.." is distributed via the Apple App Store. Acquiring the app via the App Store is subject to Apple's own data processing (for example, in the context of your Apple Account and the download). This processing is carried out by Apple, governed by Apple's privacy policy, and is outside the data controller's sphere of influence.
Access to your location is protected by the iOS operating system's permission prompt. "Aber hier leben.." only accesses your location once you have granted permission. You can change or fully revoke the location permission at any time in iOS Settings (Settings → Privacy & Security → Location Services → Aber hier leben).
"Aber hier leben.." uses no cookies, runs no tracking, and
embeds no third-party SDKs. The app's NSPrivacyTracking value
is set to false. No analysis of user behavior takes place.
A consent banner is not required: access to the device location via the operating system's location services is an OS-mediated live sensor access and does not trigger the consent requirement under § 25 TDDDG (German Telecommunications and Digital Services Data Protection Act). That provision covers the storage of, or access to, information already stored on the device - not real-time access to a sensor.
